Our Store Policies

I, the customer, acknowledge and accept all of the terms and conditions set forth herein. No completion date can or will be given on any project. However, upon request, an approximation of the estimated time to completion may be given at the discretion of MJ Gunsmithing LLC. This estimated time to completion is non-binding and may change at any time due to extenuating factors without any notification to the customer. MJ Gunsmithing LLC reserves the right to process and complete work orders in whatever order it sees fit solely based on its own discretion. MJ Gunsmithing LLC reserves the right to accept or reject any work order. The customer may at any time request the work order be returned prior to completion. MJ Gunsmithing LLC will access the proper fee for the work already performed based on MJ Gunsmithing LLC discretion and the rates and terms agreed upon previously by MJ Gunsmithing LLC and the customer. MJ Gunsmithing LLC reserves the right to retain possession of the work order until it has been fully compensated for the work, services, and parts it has provided. No exceptions. MJ Gunsmithing LLC will provide an assessment of all parts that are required for the work order to be completed; however, this is subject to change at any time. If MJ Gunsmithing LLC determines the change in the parts required for completion to be immaterial, then MJ Gunsmithing LLC will purchase the parts without customer approval and add them on to the cost of the work order. Labor prices may be quoted as a total or at an hourly rate as agreed upon by MJ Gunsmithing LLC and customer. Customer is responsible for insuring his or her firearm during the time it is in the possession of MJ Gunsmithing LLC. All firearms can only be returned to the original owner. I, the customer, acknowledge that I have voluntarily requested of MJ Gunsmithing LLC activities which may include, and are not limited to, modifications and alterations to a firearm which may affect various safety systems. I am aware that alterations and modifications of guns may be hazardous. I am voluntarily requesting that these activities take place with full knowledge of the dangers involved which may include death, dismemberment, paralysis, or other injuries. I hereby agree to accept any and all risks and verify this statement by placing my signature on this contract. I release MJ Gunsmithing LLC from any and all liability for any alterations or modifications that were made at my request. Furthermore, I, warrant herein that I am not requesting any alterations or modifications that violate any state or federal law(s). As consideration for the gunsmithing being performed pursuant to my direction, I hereby agree that I, my assignees, heirs, distributes, guardians and legal representatives, will not make a claim against, sue, or attach the property of MJ Gunsmithing LLC or any of its affiliated organizations, for injuries or damages resulting from negligence or other acts of MJ Gunsmithing LLC, or any employee, agent or contractor of MJ Gunsmithing LLC any of it affiliated organizations as a result from my request for modification or alteration to a gun. I hereby release MJ Gunsmithing LLC and any of its affiliated organizations from all actions, claims or demands that I, my assignees, heirs, distributes, guardians or legal representatives now have or may hereafter have for injuries or damages resulting from any work performed by MJ Gunsmithing LLC. I am informed, recognize, and understand that any alterations which I have requested to be done to my firearm, pursuant to the work order, may release the manufacture from any liability from any accident should any occur. I am informed, recognize, and understand by reading and signing the work order, that by requesting that these changes occur, I am also releasing the gunsmith; both individually and in any business form, from any liability should any accident occur because of the work performed by the gunsmith. The customer will indemnify and defend MJ Gunsmithing LLC from all liability for any loss, damage or injury to persons or property arising from or related to the performance of the agreement including, without limitation, all consequential damages whether or not resulting from the negligence of the customer or customer’s agent. This agreement supersedes any and all other agreements either oral or in writing, between the customer and MJ Gunsmithing LLC with respect to the subject of this contract. This contract contains all of the covenants and agreements between the parties with respect to the gunsmithing work pursuant to the work order and each party to this contract acknowledges that no representations, inducements, promises or agreements have been made by or on behalf of any party, except those covenants and agreements embodied in this contract. No agreement, statement or promise not contained in this contract shall be binding or valid. All terms of all agreements made between the customer and MJ Gunsmithing LLC are fully integrated herein. The validity of this agreement and any of its terms or provisions, as well as the rights and duties of the parties under this agreement, shall be construed pursuant to and in accordance with the laws of the State of Wisconsin. If any term of this agreement is held by a court of competent jurisdiction to be void or unenforceable, the remainder of the contract terms shall remain in full force and effect and shall not be affected. Unless other arrangements are made, in writing, any jobs left in the shop for more than 60 days after written notification of job completion and request for payment of balance will be considered abandoned and may be sold to cover expenses. Return policy: all returns are at the discretion of MJ Gunsmithing LLC. No implied warranty of merchantability is given and is expressly denied. No implied warranty of fitness for a particular purpose is given and is expressly denied. No implied warranty of workmanlike quality is given and is expressly denied. I have read this document and understand it fully. I further understand that by signing this release, I voluntary surrender certain legal rights.

Any firearms left longer than 30 days of completion will be subject to a $10/week storage fee.

LAYAWAY POLICY

All layaways require minimum non-refundable down payment of $50. Layaways not paid in full within 90 days will be canceled.

FIREARM PURCHASE POLICY

All purchases canceled, denied or otherwise terminated will be refunded less the $50 deposit.

Background checks are conducted by the FBI NICS or the Wisconsin State DOJ. Handgun background checks can take up to 5 business days. Long Gun checks can take up to thirty, and MJ Gunsmithing LLC may never receive a final decision. MJ Gunsmithing LLC does not transfer a firearm without an approval under any circumstances.

CONSIGNEE CERTIFICATION

By my signature below I hereby certify that all my personal information provided by me, on this form to be true and correct. I certify that all firearms contemplated in this transaction herein are free from material defect(s) listed herein to MJ Gunsmithing LLC. Further, I am agreeing to consign the firearm(s) listed with MJ Gunsmithing LLC for a period of not less than 30 days from this date. I understand the firearms listed will be displayed at MJ Gunsmithing LLC and listed on an online auction. I am hereby stipulating that I will carry insurance coverage on these firearms. I expressly agree that if any firearm I convey or sell to MJ Gunsmithing LLC pursuant to this agreement is seized by a government authority on the allegation it is evidence in a crime, or is subject to any third party claim of superior title while in the possession of MJ Gunsmithing LLC resulting in loss, that I will reimburse MJ Gunsmithing LLC for its loss along with any and all fees and / or expenses related thereto, including reasonable legal fees, immediately upon MJ Gunsmithing LLC request. I agree to a fee of 20% of the actual selling price to be paid to MJ Gunsmithing LLC upon sale. There is a $50 fee for picking up any consignment firearm prior to sale. I understand auctions cannot be ended early if there are any bids and once the auction has a bid the firearm must be sold to the high bidder. I agree that the firearm must sell for the final auction sale price. MJ Gunsmithing LLC cannot guarantee any final sale prices of auctions.

Consignee Certification:

By my signature below I hereby certify that all my personal information provided by me, on this form to be true and correct.  I certify that all firearms contemplated in this transaction herein are free from material defect(s) listed herein to MJ Gunsmithing LLC.  Further, I am agreeing to consign the firearm(s) listed with MJ Gunsmithing LLC for a period of not less than 30 days from this date.  I understand the firearms listed will be displayed at MJ Gunsmithing LLC.  I am hereby stipulating that I will carry insurance coverage on these firearms.  I expressly agree that if any firearm I convey or sell to MJ Gunsmithing LLC pursuant to this agreement is seized by a government authority on the allegation it is evidence in a crime, or is subject to any third party claim of superior title while in the possession of MJ Gunsmithing LLC resulting in loss, that I will reimburse MJ Gunsmithing LLC for its loss along with any and all fees and / or expenses related thereto, including reasonable legal fees, immediately upon MJ Gunsmithing LLC request.  I understand there is a $25 charge, per firearm, for online auction posting of firearms listed.  I also agree to a fee of 15% of the actual selling price to be paid to MJ Gunsmithing LLC upon sale. There is a $25 fee for picking up any consignment firearm prior to sale.

Seller Certification:

By my signature below I hereby certify that all my personal information, provided by me, on this form is true and correct. I certify that all my firearms contemplated herein are free from material defect(s), and have not been illegally modified. I certify that I have full legal right and authority to possess, sell, trade or convey the firearm(s) listed herein to MJ Gunsmithing LLC. Further, I expressly agree that if any firearm I sell to MJ Gunsmithing LLC pursuant to this agreement is seized by a government authority on the allegation it is evidence of a crime, or is subject to any other third party claim of superior title while in MJ Gunsmithing LLC possession resulting in MJ Gunsmithing LLC loss of ownership rights, that I shall reimburse MJ Gunsmithing LLC for its purchase price along with any and all fees and/or expenses related thereto, including reasonable legal fees, immediately upon MJ Gunsmithing LLC request.

All firearm and ammunition purchases are final and thus exempt from this policy.

Accessory items and other merchandise can be returned within 30 days of the original purchase. Customer must provide the original receipt and original form of payment in order to receive a full refund. Without those we can only offer in-store credit. Items must be in a re-sellable condition.
